1. Grant of Permission

Cultural Perspectives (the Grantor) hereby grants the User permission to use the photographic images described below (“Photographic images”) under the terms and conditions outlined in this agreement.

2. Scope of Use

The User may use the photographic images solely for the following purposes:

• Resource development and education materials targeting people from non-English speaking backgrounds with disability that provide access to services or positive promotion of people with disability across inclusive campaigns.
• The photographic images can solely be used non-commercial purposes. However, approved use for some marketing and advertising will be permitted, including.
  • Website.
  • Social media.
  • Brochures.
  • Online advertising.

3. Attribution

The User must provide appropriate credit to the Grantor as follows:

• The attribution to be used as a caption attached to the photographic image.

4. Prohibited Uses

The User may not:

• Use the Photographic images for any unlawful, defamatory, or misleading purposes.
• Modify, alter, or distort the photographic images in a way that misrepresents the original intent.
• Sell, sublicense, or distribute the photographic images to third parties without prior written consent.
• Use the Photographic images for any sensitive purposes (i.e. associated with an issue that might be considered controversial or unflattering) or in a way that might cause a reasonable person to believe that the subject of the image endorses, advocates, or believes in a particular product, service, cause or opinion.

5. Duration of Permission

This permission is granted for a period of one year. The Grantor reserves the right to revoke permission at any time with written notice. The User will be notified of the lapse of their period of use with 7-days’ notice.

At the expiration of the one-year licence period, the User will no longer be permitted to reproduce (print or digital) new material featuring the image without seeking an extension to licencing.

6. Breach

In the scenario that The Grantor becomes aware of any material breaches of this usage permission, the Grantor is entitled to terminate the usage agreement or take legal action to resolve this.

7. Ownership and Copyright

The Grantor retains full ownership and copyright of the Photographic images. This agreement does not transfer any intellectual property rights to the User.

8. Liability and Indemnification

The User agrees to use the Photographic images responsibly and indemnifies the Grantor against any claims, damages, or liabilities arising from misuse of the Photographic images.

9. Governing Law

This agreement shall be governed by the laws of the State of New South Wales, Australia

10. Agreement Acceptance

By using the Photographic images, the User acknowledges and agrees to abide by these conditions.
